Understanding The Pathway

How The Subclass 191 Visa Works

The Subclass 191 visa is the permanent endpoint of the skilled regional pathway, and applicants must hold, or have held, an eligible Subclass 491 or Subclass 494 visa for at least three years before they can apply. Because the points test, occupation assessment, and either state nomination or employer sponsorship were already dealt with at the provisional stage, the Subclass 191 does not reopen any of that; it is a compliance and evidence-based assessment rather than a new competitive one. Instead, the department is checking whether you have genuinely done what your provisional visa required: living, working, and studying only within a designated regional area for the full qualifying period.

In practice, this means the Subclass 191 turns on two things: your regional residence record and your income evidence. You will generally need to provide Australian Taxation Office notices of assessment for three income years within your five years on the eligible visa, along with proof that condition 8579, the regional-living condition attached to your provisional visa, was met throughout. Health and character checks are also required and may need to be refreshed if your earlier clearances have expired. Once the Subclass 191 is granted, the regional restriction lifts entirely: you gain the right to live and work anywhere in Australia, access to Medicare, a five-year travel facility, a pathway to Australian citizenship, and the ability to include eligible family members in your application.

Eligibility Criteria

What You Need To Qualify For The Subclass 191 Visa

Hold An Eligible Provisional Visa

You must hold, or have held, a Subclass 491 or Subclass 494 visa, generally for at least three years, at the time you apply for the Subclass 191.

Live, Work & Study In A Regional Area

Throughout that three-year period, you must have lived, worked, and studied only within a designated regional postcode area, in line with your visa conditions.

Income, Health & Character Requirements

You must provide ATO notices of assessment for three income years within your five years on the eligible visa, & satisfy health & character requirements.

The Path To Permanent Residency

Your Subclass 191 Visa Application, Managed From Start To Finish

Checking where you stand.

The first step is establishing exactly where you sit against the three-year requirement. This means confirming which provisional visa you hold, calculating your eligibility date from your grant date rather than your arrival date, and reviewing your compliance history against your visa conditions from day one, not just the period closest to your application.

  •       Visa type confirmed as an eligible Subclass 491 or Subclass 494
  •       Three-year eligibility date calculated from your provisional visa grant date
  •       Compliance with visa conditions reviewed across the full period held, not just recent months
  •       Regional postcode history checked against the designated regional area list for each address held

Showing three years of genuine regional life.

This stage centres on the two requirements that carry the most weight in a Subclass 191 decision: where you actually lived, worked, and studied, and what your tax record shows for the same period. There is currently no fixed minimum income figure to reach; what is required is that you have filed and been assessed for the right number of years within the right window, alongside genuinely regional residence for the full qualifying period.

  •       Continuous residence confirmed within a designated regional postcode area throughout the qualifying period
  •       Employment or study undertaken within that same regional area, matching your visa conditions
  •       Three ATO notices of assessment identified from within your five years on the eligible visa
  •       No minimum income threshold to meet, only the requirement to have filed and been assessed for the correct period

Building a complete document set.

Once your eligibility window and income years are confirmed, the application needs a document set that backs each requirement with real evidence rather than a summary of dates. A Subclass 191 file generally draws on four categories of evidence, and gaps in any one of them can slow the assessment down even where the underlying eligibility is not in question.

  •       Visa compliance evidence: grant notices and records showing condition 8579 was met throughout your provisional visa
  •       Regional residence evidence: leases, utility bills, bank statements showing local spending, and school enrolment records where relevant
  •       Employment evidence: payslips, employment contracts, and your three ATO notices of assessment
  •       Health and character evidence: updated police clearances and medical checks where earlier clearances have expired

From ImmiAccount to grant.

The Subclass 191 application is lodged through ImmiAccount and can be submitted whether you are inside or outside Australia at the time. If your provisional visa is due to expire while the Subclass 191 is being assessed, a bridging visa is generally granted automatically to maintain your lawful status in the meantime, so a looming expiry date does not need to derail your application.

  •       Application lodged online with your complete evidence set attached
  •       Bridging visa automatically granted if your provisional visa is due to expire during processing
  •       Department assessment carried out, which may include requests for further information or updated checks
  •       Permanent residency granted, along with a five-year travel facility from the date of grant
